JARA DRAPAŁA & PARTNERS is advising Belgium’s Ontex Group, a supplier of disposable personal hygiene products, on the construction of a new plant in Radomsko.

The plant will be developed by Panattoni Europe in a built-to-suit formula.

The JARA DRAPAŁA & PARTNERS team is led by Maciej Chrzan (Partner), supported by Michał Urbański (Attorney) and Magdalena Zasiewska (Head of Taxes).

JD&P obtains permit of the General Directorate for National Roads and Motorways after success in court of first instance

JARA DRAPAŁA & PARTNERS law firm (JD&P) having won the case before the court of first instance negotiated and made a settlement with the General Directorate for National Roads and Motorways (GDDKiA), according to which one of the leading contractors of road works, has been paid PLN 12 million. As part of the settlement, a number of claims of the general contractor have been settled, including claims for remuneration for substitute works, costs incurred within the extended Completion Period, overall costs of the construction office, costs of adjustment to general requirements, as well as damages. The contract covered construction of one of expressways in “build” formula (so called FIDIC red book). Thanks to the success in court of first instance and further involvement of JD&P, the contractor received payments it was entitled to, without the need of conducting further proceedings for at least three or four years and covering related costs.

The contractor was represented by Professor Przemysław Drapała, Partner, head of Court and Arbitration Proceedings and Infrastructure, together with the JD&P team: Andrzej Sokołowski, Partner, Wojciech Bazan, attorney, and Filip Rasała, legal advisor.
